MH Power Solutions: terms

Who we are. MH Power Solutions, [NAME AND ADDRESS: your full name if you are a sole trader, or company name, number and registered address]. Phone [PHONE]. Email [email protected]. We are registered with NAPIT (registration number [NAPIT NO]) and hold public liability insurance of £2,000,000. We are not VAT registered, so no VAT is added to our prices.
Part 1. Booking terms
1. A request is not a booking until we confirm it. When you send a booking request on our website, we check it and then confirm by phone or message. Until we confirm, there is no contract. We can decline a request, for example if we cannot get there on that day.
2. Prices shown online are rough guides. They help you plan. They are not a quote. We confirm the price of the job with you before any work starts, either as a written quote or on site after we have seen the job. You do not have to go ahead.
3. Your details. We use the details you give us to arrange and carry out your job and to keep the records we need. Please read our privacy notice on the booking page. Please give us accurate details so we can reach you.
4. Changing or cancelling a booking. - You can change or cancel a booking for free up to 48 hours before the time. Use your private booking link, your login, or phone us. - If you cancel with less than 48 hours' notice, or nobody is there to let us in, we may charge a reasonable fee for the time we have lost. It will never be more than the loss we suffered, and we will tell you before we charge anything. - If we have to change or cancel a booking (for example, because of illness, an emergency or very bad weather) we will tell you as soon as we can and offer another time. You will not be charged.
5. Your 14-day right to cancel. Because you book with us online, you normally have the right to cancel the contract within 14 days of the day we confirm it, without giving a reason. To cancel, tell us clearly by email, phone or post (you can use the form at the end of these terms). If you want us to start the work within those 14 days, you must ask us to, and when you tick the box on our booking page you are asking us to. If you then cancel after we have started, you must pay for the work we have already done, in proportion to the whole job. If we have finished the work, you can't cancel after that. This right may not apply where you ask us to come urgently to carry out repairs. Your other legal rights are not affected.
6. On the day. Please make sure someone aged 18 or over is at the property, we can park or unload nearby, and the area we need to work in is clear and safe. Please tell us about anything that could be dangerous (for example asbestos, an unsafe floor, or animals). We may need to switch off the electricity for some time. Please save your work on computers and expect clocks and timers to need resetting.
Part 2. Terms of business (the work)
7. Quotes and estimates. A quote is a fixed price for the work described in it, valid for 30 days unless it says otherwise. An estimate is our best guess and is not a fixed price. Prices are in pounds sterling. If we find something we could not reasonably have known about before we started (for example hidden damage, old or unsafe wiring behind a wall, or a different cable route), we will stop, explain it, and agree any change to the price with you before going on. We will not do extra work you haven't agreed.
8. Paying. You pay when the work is completed. We will give you an invoice, and you can pay by any of the methods shown on it. If you have asked us to order materials in advance, we may ask you to pay for those first and we will tell you before we order.
9. Materials. We use materials of satisfactory quality that suit the job. If you supply materials, we may refuse to fit them if they are unsuitable or unsafe, and we cannot guarantee them. Manufacturers' warranties on equipment such as consumer units, chargers and lighting stay between you and the manufacturer.
10. Certificates, notifications and records. Where the law requires it, we will notify the work through our scheme (NAPIT) and give you the right certificate, such as an Electrical Installation Certificate or a Minor Works Certificate, once the work is complete. Any scheme fee will be shown on the quote. We keep copies of the reports and certificates we issue for at least 6 years.
11. Electrical Installation Condition Reports (EICRs). - What it is. An EICR is an inspection and testing of an existing installation, to report on its condition on the day. It is not a guarantee that the installation will stay safe. - Scope and limits. Before we start we agree with you which parts we will inspect and test. We cannot inspect what we cannot see or reach (for example cables hidden in walls, floors or ceilings, or areas that are locked or blocked), and we may test a sample of the installation. Anything we could not inspect is recorded on the report. - The result. We report what we find and classify each observation in line with BS 7671 and the current guidance of our scheme. The report states whether the installation is satisfactory or unsatisfactory, and recommends when it should next be inspected. - Faults found. An EICR reports problems but does not fix them. We will only carry out repairs if you ask us and we agree a price. You are free to use any other competent electrician. - Landlords. If you are a landlord, you are responsible for meeting your own legal duties (for example, acting on the report within the time the law and the report require, and giving copies to tenants and others). We provide the report to the person who instructed us.
12. Our guarantee. We guarantee our workmanship for 12 months from the day we finish the work. If a fault is caused by our workmanship, we will put it right at no cost to you. The guarantee does not cover wear and tear, misuse, damage caused by other people or other trades, faults in materials or equipment you supplied, or changes made by someone else. It is in addition to your legal rights and does not replace them.
13. Your legal rights. If you are a consumer, we must carry out the work with reasonable care and skill, for a fair price and within a reasonable time. If we do not, the law gives you rights to have the work repeated or to a price reduction. Nothing in these terms limits those rights.
14. Our responsibility. We are responsible for loss or damage that is a foreseeable result of us not doing the work with reasonable care and skill. We are insured for up to £2,000,000. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. If you are a business customer (for example, a landlord letting property as a business), we are not liable for loss of profit, loss of rent or other indirect loss, and our total liability for any one job is limited to £2,000,000.
15. Things outside our control. We are not responsible for a delay or failure caused by something we could not reasonably prevent (for example severe weather, supplier problems, illness, or a power cut). We will tell you as soon as we can and agree a new date.
16. Complaints. If something is wrong, please tell us straight away by phone or email so that we can put it right. We will reply within 14 days. If we cannot sort it out, as a NAPIT registered contractor you can use NAPIT's complaints process, and you can get free advice from Citizens Advice.
17. Privacy. How we look after your details is explained in our privacy notice.
18. General. We may update these terms. The version that applies to you is the one in force when we confirmed your booking or quote. If any part of these terms turns out not to be enforceable, the rest still applies. These terms are governed by the law of England and Wales. If you are a consumer, you may bring a claim in the courts of the part of the UK where you live.
